These Terms and Conditions constitute a legally binding agreement made between you, whether individually or on behalf of any entity ("the User", "you", "your"), and eSolutions 88, LLC, located at 390 Northeast 191st Street, Miami, FL 33179, United States ("eSolutions 88", "FlyProof", "we", "us", "our"), concerning your access to and use of the FlyProof website (https://flyproof.org) as well as any related applications and/or services ("the Site"). The Site provides the following service: the sale and intermediation of temporary airline flight reservations intended as proof of onward travel for immigration and travel documentation purposes ("the Service").

The User agrees that by accessing the Site and/or the Service, he/she has read, understood, and agrees to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are prohibited from using the Site and/or the Service and you must discontinue use immediately. You further agree that we may change these Terms and Conditions from time to time by updating this page, and that such changes will take effect immediately upon posting. Your continued use of the Site and/or the Service constitutes your acceptance of any changes and of the prevailing Terms and Conditions.

1. General Conditions

1.1. The User's use of this Site and/or the Service, whether as an individual or on behalf of a company, is subject to the terms of a legal agreement between the User and eSolutions 88, LLC. The User is also responsible for ensuring all persons who access the Site through his/her internet connection comply with these Terms and Conditions. The User may not assign, sub-license or otherwise transfer any of his/her rights under these Terms and Conditions.

1.2. A User who does not consent to these Terms and Conditions is obliged to immediately stop using the Site and/or the Service and leave the Site.

1.3. All information on the Site is available in English and other selected languages. FlyProof does not bear any responsibility for translation errors or in connection with the User's incorrect understanding of any language used on the Site.

1.4. Additional policies which also apply to the User's use of the Site include our Privacy Policy, which sets out the terms on which we process any personal data we collect from the User, or that the User provides to us. By using the Site, the User consents to such processing and warrants that all data provided by the User is accurate.

1.5. FlyProof controls and operates this Site from the United States. We make no representation that materials on the Site or the services described therein are appropriate or available for use in the User's location.

2. Service Description

2.1. FlyProof provides temporary onward flight reservations intended solely as proof of onward travel for immigration or travel documentation purposes. The reservation provided is not an airline ticket, does not constitute a confirmed booking for actual travel, and does not guarantee a seat on any flight. It is a temporary reservation that exists in an airline reservation system (GDS) for a limited period of time.

2.2. FlyProof provides the User with a flight reservation code (PNR Code). In no event will an e-ticket number be provided unless specifically confirmed and paid for through the airline directly within the reservation validity period. The PNR Code is a genuine, verifiable booking reference that can be confirmed through the airline's reservation system.

2.3. FlyProof is an independent service provider and is not affiliated with any airline, airport, government authority, immigration office, or travel agency. FlyProof does not provide transportation services and does not operate flights.

2.4. The Service does not guarantee and/or provide the User with a flight ticket for actual travel. Any ticket would have to be purchased separately and directly from the airline within 48 hours of the reservation being placed.

3. Flight Selection & Airport Substitution

3.1. FlyProof automatically selects the most suitable flight for the User's itinerary based on availability and pricing. By using our Service, the User acknowledges and agrees that:

• The specific airline, flight number, routing, number of stops, and flight times are determined automatically by FlyProof's systems and cannot be chosen or guaranteed by the User.
• If flights from the User's selected departure airport are unavailable, FlyProof may substitute a nearby airport within the same country. For example, if flights from CXO (Conroe) are unavailable, FlyProof may book from IAH (Houston) instead.
• If flights to the User's selected destination are unavailable, FlyProof may substitute an alternative destination. The reservation will always depart from the same country as the User's selected origin.
• FlyProof does not guarantee that the exact airports, airlines, or routes selected during the booking process will appear on the final reservation.
• Any substituted route will still serve as valid proof of onward travel for immigration purposes, as it demonstrates the User's intention to depart the country.

3.2. FlyProof reserves the right to change the airline, flight number, departure time, or routing of any reservation at any time before delivery, without prior notice to the User, provided that the reservation continues to serve as proof of onward travel.

4. Reservation Validity

4.1. Reservations issued by FlyProof are typically valid for approximately 48 hours from the time of issuance unless otherwise stated. After this period, the reservation will expire automatically. No action is required from the User to cancel the reservation.

4.2. FlyProof does not control the airline reservation systems and therefore cannot guarantee the exact duration of the hold. The reservation may expire earlier or later than 48 hours depending on airline policies, availability changes, or GDS system behaviour.

4.3. FlyProof shall not be responsible for any consequences arising from the use of an expired reservation, including but not limited to denied boarding, denied entry, or any other travel disruption.

4.4. The User acknowledges that the reservation is temporary and is intended to demonstrate proof of onward travel at a specific point in time. The User should not rely on the reservation for actual travel arrangements.

5. Add-on Services

5.1. FlyProof offers the following optional add-on services during the booking process:

• Flexible Booking: Allows one change to the flight date, origin, or destination, and one passenger name correction, within the reservation validity period. This add-on is non-refundable once purchased and subject to flight availability at the time of the change request.
• Activate Later: Allows the User to pay now and receive an activation link by email. The User may activate the reservation at a time of their choosing. Once activated, the reservation is valid for approximately 48 hours. Activation links must be used within 30 days of purchase.
• Round Trip: Allows the User to book both an outbound and return flight reservation. Each leg is booked as a separate reservation and may have different PNR Codes, airlines, and routing. The same airport substitution policy (Section 3) applies to each leg independently.

5.2. Add-on pricing is displayed at checkout and is subject to change without notice. Add-ons are non-refundable once the reservation has been generated or the activation link has been sent.

6. eSIM Data Packages

6.1. FlyProof offers optional travel eSIM data packages for select destinations. These are provided through a third-party eSIM provider and are subject to the following conditions:

• eSIM packages are delivered digitally via email with a QR code for activation.
• eSIM packages are non-refundable once the eSIM profile has been allocated and delivered.
• Device compatibility depends on the User's device. FlyProof is not responsible for eSIM compatibility issues, activation failures, or coverage limitations related to the User's device or carrier settings.
• Data volume, validity period, speed, and coverage are as described at the time of purchase and may vary based on local network conditions.
• eSIM purchases are separate from flight reservations and are governed by the eSIM provider's own terms of service in addition to these Terms and Conditions.

7. Obligations of the User

7.1. The User must not use the Site and/or Service for any unlawful purpose. The User must not copy, monitor, or access any part of the Site using an automated mechanism or process such as a robot, spider, or scraper. The User must not attempt to gain unauthorised access to any part of the Site by hacking or any other similar means, and the User must not test the Site for vulnerability or transmit any virus, malware, or harmful component to the Site.

7.2. The User specifically agrees:

• Not to violate the rights of FlyProof or third parties through the use of the Site and/or Service.
• Not to impersonate another person or engage in any illegal activities on the Site.
• Not to use the Site for commercial, promotional, or other purposes that violate these Terms and Conditions.
• Not to attempt to access the accounts, login credentials, or passwords of other Users or FlyProof personnel.
• Not to use the Site and/or the Service to violate any IATA and/or airline rules (including fare rules), directions, or guidelines relating to booking practices, including misuse or abuse of booking classes, fraudulent, duplicate, speculative, or fictitious bookings.
• To use the Site and/or the Service only for genuine proof of onward travel purposes, provided that the Service does offer the User the flexibility of having the reservation expire automatically within approximately 48 hours.
• Not to use the Site and/or the Service for the sole and exclusive purpose of obtaining access to visa facilities for any country, territory, or jurisdiction, without having any genuine intention to travel or depart the country as indicated in the reservation.

7.3. The User must be 18 years of age or older to use the Site and/or Service. By accessing this Site and/or using the Service, the User represents and warrants that he/she is 18 years of age or older, and that he/she has the right, authority, and legal capacity to agree to and abide by these Terms and Conditions.

7.4. If any claim of a third party is brought against FlyProof in connection with the activities of the User, the User must do everything in his/her power to consider and satisfy such a claim. If FlyProof incurs any expenses related to such a claim, the User undertakes to reimburse such expenses in accordance with applicable law.

8. Accuracy of Information

8.1. The User must ensure that all personal and travel information provided during the order process is accurate, complete, and matches the User's passport or travel document exactly.

8.2. Once a reservation has been generated, no modifications or corrections can be made unless the Flexible Booking add-on was purchased. This includes but is not limited to:

• Name corrections or changes
• Date changes
• Route or destination changes
• Passenger details or gender corrections

8.3. If incorrect information is submitted and no Flexible Booking add-on was purchased, the User must place a new order at full price. FlyProof is not responsible for any consequences arising from incorrect information provided by the User.

9. Payment & Pricing

9.1. All payments are processed securely through Stripe or other approved payment processors. FlyProof does not store, access, or retain credit card numbers or payment credentials. Prices are displayed in the currency shown at checkout.

9.2. Prices for the Service are subject to change without notice. FlyProof reserves the right at any time to modify or discontinue the Service (or any part thereof) without notice. FlyProof shall not be liable to the User or to any third party for any modification, price change, suspension, or discontinuance of the Service.

9.3. Promotional discounts, including recovery offers and time-limited promotions, are subject to the following conditions:

• Discounts may only be used once per booking and per customer.
• Discounts may be withdrawn at any time without notice.
• Discounts cannot be combined with other offers unless explicitly stated.
• FlyProof reserves the right to void any booking made with an invalid or abused discount code.

10. Refund Policy

10.1. Due to the instant digital nature of the Service and the immediate generation of reservations, all sales are final.

10.2. No refunds will be issued once a reservation has been created and delivered to the User.

10.3. The User may request a full refund only in the following situations:

• The User makes a duplicate payment due to a technical issue with the Site.
• FlyProof fails to deliver a valid reservation within 12 hours of payment.

10.4. Refund requests must be submitted by email to [email protected] within 24 hours of purchase, with supporting information for FlyProof's consideration.

10.5. Any refund will be strictly subject to FlyProof's sole discretion. Refunds will be processed within 14 business days of a successful refund request. This clause does not create any independent or unconditional right to a refund.

10.6. By purchasing the Service, the User expressly agrees to the immediate execution of the Service and acknowledges that the right of withdrawal or cancellation does not apply once the reservation has been generated and delivered.

11. Delivery

11.1. Reservations are typically delivered within 60 seconds of payment via email to the address provided during checkout.

11.2. In rare cases, delivery may take up to 12 hours due to airline system delays, high demand, or technical issues. If delivery is delayed beyond 15 minutes, the User will receive a notification email confirming that FlyProof is processing the reservation.

11.3. The User is responsible for providing a valid and accessible email address. FlyProof is not responsible for delivery failures caused by incorrect email addresses, spam filters, or email provider issues.

11.4. The delivered reservation includes a PDF ticket document with the PNR Code, flight details, and passenger information. This document should be presented at check-in or immigration when proof of onward travel is required.

12. Acceptability of Reservations

12.1. FlyProof does not guarantee that airlines, border authorities, immigration officers, consular staff, or any government authority will accept the reservation as proof of onward travel.

12.2. Acceptance of such documentation is entirely at the sole discretion of the relevant authority. Different countries, airlines, and individual officers may have different requirements and standards for proof of onward travel.

12.3. FlyProof does not guarantee any success in entering countries, obtaining visas, passing immigration checks, or any other situations for which the User may choose to use the Service.

12.4. The User assumes full responsibility for determining whether the reservation meets their travel, immigration, or visa requirements. The User expressly acknowledges that the use of the PNR Code and reservation document provided by the Service in any situation is at his/her own risk.

13. Marketing Communications

13.1. By opting in during checkout, the User agrees to receive travel tips, deals, promotional offers, and product recommendations from FlyProof via email.

13.2. The User can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting [email protected].

13.3. Unsubscribing from marketing emails will not affect transactional emails related to the User's bookings, such as confirmation emails, delay notifications, and support communications.

13.4. FlyProof will never sell, rent, or share the User's email address with third parties for their own marketing purposes.

14. FlyProof's Rights

FlyProof reserves the right to:

• Block any User's access to the Site without prior notice if abuse or fraud is suspected.
• Conduct routine maintenance or other works ensuring the working capacity of the Site without prior notice.
• Require the User to provide a copy of personal identification for inspection and confirmation of the User's identity and age.
• Monitor Users' activities and cancel any reservation placed by any User which appears to be fraudulent, duplicate, speculative, or fictitious in nature.
• Permanently blacklist or prevent any further usage of the Site and/or the Service to any User engaging in prohibited activities, at FlyProof's sole discretion.
• Modify, suspend, or discontinue any part of the Service at any time without prior notice.

15. Limitation of Liability

15.1. The material on the Site and any material made available through the Service is provided "as is" and without conditions or warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, FlyProof disclaims all conditions and warranties, express or implied, including but not limited to all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

15.2. Subject to applicable law, under no circumstances shall eSolutions 88, LLC, its directors, officers, employees, affiliates, agents, contractors, suppliers, or service providers be liable to the User or any other person or entity for any direct, indirect, special, incidental, consequential, punitive, or other damages, including lost profits, goodwill, business opportunity, personal injury (including death), and property damage, that may result from:

• The use of, or the inability to use, the Site, Service, or any material therein
• Refusal of entry by immigration authorities or border agencies
• Denied boarding by any airline
• Expired reservations or early cancellation by airline systems
• Incorrect information submitted by the User
• Third-party airline or GDS system changes, outages, or errors
• Substitution of departure or arrival airports as described in Section 3
• eSIM compatibility issues, data coverage limitations, or activation failures
• Any delay in delivery of the reservation or eSIM package
• Any third-party website linked from the Site
• The conduct of any other User of the Site

15.3. FlyProof assumes no responsibility or liability for any loss, damage, or expense incurred arising from any use of the Service provided by FlyProof. The User expressly acknowledges that the use of the PNR Code provided by the Service in any situation is at his/her own risk.

15.4. In no event shall FlyProof's total liability to the User for damages, losses, and causes of action, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by the User for the specific Service giving rise to the claim.

16. Indemnification

The User hereby agrees to defend, indemnify, and hold eSolutions 88, LLC, its affiliates, and each of its respective agents, licensees, successors, and assigns, harmless from and against any and all claims, actions, or proceedings of any kind and from any and all damages, liabilities, costs, and expenses, including reasonable legal fees, relating to or arising out of:

• The User's use of this Site and/or the Service
• Any breach or alleged breach of any of the User's warranties, representations, or agreements under these Terms and Conditions
• Any violation of applicable laws, regulations, or third-party rights by the User
• Any claim brought by a third party in connection with the User's activities on the Site

17. Intellectual Property

17.1. FlyProof and eSolutions 88, LLC own the intellectual property rights for all materials on this Site, including text, graphics, logos, software, design, and digital content, or have a valid license from third parties to use such materials.

17.2. All trademarks, service marks, graphics, and logos used on this Site are the property of FlyProof and eSolutions 88, LLC or their respective owners.

17.3. Unless expressly stated, no part of the Site may be copied, reproduced, republished, uploaded, posted, transmitted, reverse-engineered, or distributed in any way without prior written consent from FlyProof.

18. Fraud Prevention

18.1. FlyProof reserves the right to cancel or refuse any order that appears fraudulent, abusive, or in violation of these Terms and Conditions, at its sole discretion and without prior notice.

18.2. Additional identity verification may be requested in certain circumstances, including but not limited to high-value orders, multiple orders from the same email address, or orders flagged by our fraud detection systems.

18.3. Users repeatedly placing and cancelling reservations, or engaging in any pattern of abuse, will be monitored and may be limited, blacklisted, or permanently banned from using the Service.

19. Termination

19.1. These Terms and Conditions are and shall remain effective until terminated. The User may terminate these Terms and Conditions by ceasing to use the Site and destroying any and all material obtained from the Site.

19.2. FlyProof may immediately terminate these Terms and Conditions, including the User's access to the Site and Service, if the User breaches or fails to comply with any material term or provision of these Terms and Conditions.

19.3. Upon termination, the User must discontinue use of the Site and destroy any and all material obtained from the Site. Termination does not affect any rights or obligations that accrued prior to the date of termination, including but not limited to payment obligations and limitation of liability.

20. Settlement of Disputes

20.1. A User who believes that his/her rights and interests were violated due to the actions of FlyProof should lodge a complaint via email to [email protected], which will be reviewed by FlyProof within 30 calendar days.

20.2. A User who lodges a complaint shall agree to provide FlyProof with complete information relating to the alleged violation. If the User provides false information, he/she shall indemnify FlyProof for all losses and expenses incurred in investigating the complaint.

20.3. These Terms and Conditions and any disputes arising under or related to these Terms and Conditions (whether in contract, tort including negligence, statute, or otherwise) will be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States, without reference to its conflicts of law principles.

20.4. Any legal actions, suits, or proceedings arising out of these Terms and Conditions will be brought exclusively in the courts located in Florida, United States, and the User hereby accepts and submits to the personal jurisdiction of these courts with respect to any legal actions, suits, or proceedings arising out of these Terms and Conditions.

20.5. These Terms and Conditions and any document expressly referred to herein represent the entire agreement between FlyProof and the User in relation to the use of the Site and/or Service and supersede any prior agreement, understanding, or arrangement, whether oral or in writing.

20.6. In the event any provision of these Terms and Conditions is declared to be void, invalid, or unlawful by any court or tribunal of competent jurisdiction, such provision shall be deemed severed from the remainder of these Terms and Conditions and the balance shall remain in full force and effect.

20.7. No failure on the part of FlyProof to enforce any part of these Terms and Conditions shall constitute a waiver of any of FlyProof's rights under these Terms and Conditions. Only a specific, written waiver signed by an authorized representative of eSolutions 88, LLC shall have any legal effect.

FlyProof™ upholds the highest standards in respecting international civil aviation directions and guidelines relating to booking practices, including but not limited to any misuse of booking classes, fraudulent, duplicate, speculative, or fictitious bookings. Users repeatedly cancelling reservations without purpose will be monitored and may be limited or banned permanently from using our service.
